Future Frequency – Terms & Conditions

By enrolling in the Future Frequency – Live Sessions Program (“Program”), you (“Client,” “You,” or “Participant”) agree to the following Terms and Conditions, which constitute a legally binding agreement between you and Future Frequency (“Company,” “We,” “Our”). Please read carefully before completing your purchase.

 

1. Program Access

Upon purchase, you will receive access to the Program as described on the sales page or checkout page at the time of your enrollment.

• We reserve the right to modify, update, or enhance Program content, structure, or delivery methods at any time, without obligation to you.
• You will have lifetime access to the official Future Frequency course, including updates, provided that you comply with these Terms. If access delivery changes (e.g., new platform), we will provide alternate means of access.

 

2. Privacy & Data Protection

•  We respect your privacy. Your personal information will never be sold, rented, or shared with third parties, except as required by law or to process payments and deliver Program services.
•  Please note: This Privacy commitment applies only to Future Frequency. If you acquire or use third-party software, platforms, or services, your information will be governed by their respective privacy policies and terms of service. Future Frequency is not responsible for the policies, practices, or security of any third-party providers. 

 

3. Payment & Billing

•  The Program fee is due in full at the time of purchase, unless you are enrolled in a payment plan.
•  If you select a payment plan, you are contractually obligated to complete all scheduled payments, regardless of whether you continue or complete the Program.
•  Your enrollment covers a 90-day Program period (“Initial Term”).
•  After 90 days, community access will automatically renew at $111/month unless canceled by you prior to the next billing date.
•  You may cancel future billing for community access at any time, but no refunds will be issued for amounts already paid.
• No refunds will be issued under any circumstances, including but not limited to non-participation, schedule conflicts, or dissatisfaction with the Program.

• By purchasing the Program, you agree not to initiate a chargeback or payment dispute with your bank or payment provider without first contacting Future Frequency to attempt resolution.

  If a chargeback is initiated in violation of these Terms, Future Frequency reserves the right to immediately terminate access to all Program materials, sessions, and community access without refund.

  You also agree that any unpaid balances, chargeback fees, or associated recovery costs may be pursued through collections or legal action if necessary.

 

4. No Guarantees & Acknowledgment of Risk

• The Program is educational and informational only.
•  Nothing in the Program constitutes a recommendation to buy, sell, or trade any financial instrument.
• Future Frequency is not a broker, financial advisor, investment advisor, or commodity trading advisor
• We do not guarantee financial results, profits, or outcomes. 
• You acknowledge that results depend on your personal effort, discipline, decisions, and market conditions — all of which are outside the Company’s control.
• You assume full responsibility for your trading decisions and outcomes.

 

5. Support Commitment

• During your 90-day Program period, you will receive access to scheduled live sessions, coaching calls, and community support as outlined at checkout. While no specific results are guaranteed, we are committed to delivering the full scope of support during the Program term.

 

6. Intellectual Property & License of Use

• All content provided in the Program, including but not limited to videos, recordings, PDFs, trade strategies, course materials, templates, and community resources, are the property of Future Frequency and protected by copyright, trademark, and intellectual property laws.
• You are granted a limited, personal-use, non-transferable license to access and use the Program materials.
• You may not copy, share, resell, record, or distribute Program materials in any form without prior written consent.
• Unauthorized use of Program content may result in termination of access without refund and potential legal action.

 

6A. Software, Indicators, and Downloadable Tools License

From time to time, Future Frequency may provide downloadable software, trading indicators, scripts, tools, templates, or other digital resources (collectively, the “Software”).

All Software provided through the Program or community is licensed intellectual property and remains the sole property of Future Frequency.

By downloading, installing, or using any Software provided by Future Frequency, you agree to the following:

License Grant

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal use only in connection with your participation in the Program.

This license does not transfer ownership of the Software.

All intellectual property rights remain with Future Frequency.

Restrictions

You may NOT:

• Share, distribute, sublicense, sell, lease, gift, or transfer the Software to any third party

• Provide access to the Software to individuals who are not enrolled in the Program or community

• Upload or distribute the Software on forums, websites, or file-sharing platforms

• Copy, reproduce, modify, or create derivative works from the Software

• Reverse engineer, decompile, disassemble, or attempt to extract source code

• Use the Software for commercial resale, redistribution, or competing products

Any violation of these restrictions immediately terminates your license to use the Software.

Future Frequency reserves the right to revoke access to Software and Program materials at its sole discretion in the event of misuse or unauthorized distribution.

No Warranty

All Software is provided “AS IS” without warranties of any kind, express or implied, including but not limited to accuracy, reliability, performance, merchantability, or fitness for a particular purpose.

Future Frequency does not guarantee that any Software will be free from errors, bugs, interruptions, or compatibility issues with third-party platforms (such as NinjaTrader or other trading platforms).

Trading Risk Disclaimer

Software and indicators are provided for educational and informational purposes only.

They do not constitute financial, investment, or trading advice.

Trading futures, equities, cryptocurrencies, and other financial instruments involves substantial risk of loss.

You acknowledge that you are solely responsible for all trading decisions and outcomes.

Past performance is not indicative of future results.

Limitation of Liability

To the fullest extent permitted by law, Future Frequency shall not be liable for any losses, damages, or claims arising from the use or inability to use any Software provided through the Program.

This includes, without limitation:

• Trading losses

• Lost profits

• Business interruption

• Data loss

• Indirect or consequential damages

 

7. Community Guidelines

• You agree to participate respectfully in group sessions, forums, and community spaces.
• Harassment, abusive language, or disruptive behavior will result in immediate removal from the Program without refund.
• You are responsible for maintaining confidentiality of your account, passwords, and login information.

 

8. Professional Conduct

• We commit to providing all coaching, feedback, and community interactions in a professional, respectful, and supportive manner.

 

9. Scheduling & Attendance

• Group sessions and live trading calls are scheduled by the Company and may be recorded for training purposes.
• The Company reserves the right to adjust schedules or reschedule sessions if necessary. Sessions may be canceled or rescheduled due to travel, illness, or unforeseen circumstances. The Company is not obligated to provide make-up sessions, though recordings or alternative resources may be provided at the Company’s discretion.
• Live sessions may include educational discussion of real-time market conditions. These sessions are for educational purposes only and should not be interpreted as trading signals or recommendations.

 

10. Technology & Third-Party Services

• You are responsible for securing a stable internet connection and required hardware/software (e.g., Zoom, NinjaTrader).
• The Company is not liable for disruptions caused by your internet, software, or third-party providers (e.g., Stripe, Zoom, NinjaTrader).
• The Program and content are provided “as is” without warranties of any kind (see Section 11).

 

11. Disclaimers & Limitation of Liability

• All services, sessions, and materials are provided “as is” without warranty of any kind, either expressed or implied. 
• Future Frequency makes no representation that materials are free from errors, interruptions, or technical issues.
• To the fullest extent permitted by law:
• Future Frequency disclaims all liability for any losses, damages, or claims arising from your participation in the Program.
• Future Frequency shall not be liable for lost profits, trading losses, or consequential damages of any kind. 
• By enrolling, you agree that you will not hold Future Frequency responsible for your trading outcomes, financial decisions, or use of Program materials.

 

12. Indemnification & Legal Fees

• You agree to indemnify and hold harmless Future Frequency, its owners, officers, and agents from any claims, damages, liabilities, or expenses (including attorneys’ fees) arising from your use of the Program, your conduct, or your breach of these Terms.
• If you initiate any claim or legal action against Future Frequency and do not prevail, you agree to reimburse the Company for all legal fees, costs, and expenses incurred in defending such action.

 

13. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States.
• Any disputes shall be resolved exclusively in the courts of Salt Lake County, Utah.
• If any part of these Terms is found invalid or unenforceable, the remainder shall still apply. These Terms are intended to be fair and reasonable to both parties.

 

14. Earnings Disclaimer

• The Program is for educational purposes only.
• We do not claim or guarantee that you will earn money, achieve specific trading results, or replicate the success of any other trader.
• Your success depends on your personal effort, discipline, skills, market conditions, and other factors beyond our control.
• Past performance of any trader or student is not indicative of future results.

 

15. Non-Discrimination & Equal Opportunity Policy

Future Frequency is committed to providing an inclusive, respectful, and professional learning environment for all participants.

Participation in the Program is open to individuals regardless of race, color, ethnicity, national origin, sex, gender identity or expression, sexual orientation, age, religion, disability, marital status, veteran status, or any other characteristic protected by applicable law.

We do not tolerate discrimination, harassment, or exclusionary conduct by participants, instructors, staff, or moderators on any protected basis. Any behavior that violates this policy may result in immediate removal from the Program without refund, at the Company’s sole discretion.

Nothing in this policy shall be interpreted to require the Company to retain participants whose conduct violates Program rules, disrupts the learning environment, or breaches these Terms and Conditions.

 

16. Acknowledgment

By completing your purchase, you acknowledge and agree that:

• You have read, understood, and accepted these Terms and Conditions.
• You understand that no refunds will be issued.
• You accept that all payment plans must be paid in full, regardless of whether you continue in the Program.
• You understand that trading involves risk, and no results or profits are guaranteed.

 

Modification of Terms

Future Frequency reserves the right to modify, update, or revise these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated Terms.

Continued participation in the Program after such changes constitutes acceptance of the revised Terms and Conditions.
